「按揭」一詞是英文「Mortgage」的粵語音譯,最初起源於西方國家,本意屬於英美平衡法體系中的一種法律關系,後於十多年前從香港引入內地房地產市場,先由深圳建設銀行在當地試行,之後逐漸在內地流行起來,因為在房地產領域頻頻出現並正式運用於文本,其含義逐漸演化成了「抵押貸款」,目前在國內已經被正式稱為「個人購置商品房抵押貸款」。

劃分

香港回歸祖國前,香港對按揭的規定分為廣義和狹義兩種。

廣義的按揭是指任何形式的質押(質押是動產的抵押)和抵押;

狹義的按揭是指將房地產轉移到貸款人名下,等還清貸款後,再將房地產轉回到借款人(抵押人)名下。

抵押與按揭的區別

《城市房地產管理法》和《擔保法》所規定的抵押與香港的按揭有一定的區別,即這兩個法律對抵押的界定都以下轉移佔有為條件。
由於房屋價值量大,即使在人均收較高的國家或地區,購房者一次籌足購房的款項是有一定困難的。如果所有的購房者都要等到購房款齊備後再買房,少則要十多年,多則要數十年,而且在這漫長的等待時間里還要交付因租用房屋而承擔的費用。
近幾年來,由於金融機構的參與,銀行向購房者發放貸款,使購房者得以提前獲得住房。
對房地產開發公司來說,銀行向購房者發放貸款。使購房者提前買房,有利於房地產開發公司回憶資金的周轉,以獲得更多的利潤。
對銀行來說,如果直接向房地產開發公司發放貸款,開發公司用貸款來建造的房屋並不能很快地全部銷售出去,這勢必影響開發公司的還貸能力。如果直接向購房者發放貸款,購房者將所得的貸款全部用於購房,由於給予購房者的貸款額要低於房價,購房者自己還要投入一筆資金用以購買房屋,又由於購房者在獲取貸款時以購得的房屋作抵押,所以還貸的可靠性得到充分的保證。

這種抵押貸款,對於購房者、房地產開發公司和銀行都是有利的,而且促進了房地產市場的繁榮。因此,近幾年來比較流行。一些房地產開發公司便開始將這種抵押貸款稱為「按揭」,有的售房廣告標明「提供×成按揭」,即是銀行可以提供給購房者的貸款比例,如「六成」就是可以提供房價60%的貸款。銀行為了貸款的安全起見,一般最高只能提供房價70%的貸款。
按揭與抵押貸款不完全相同,對按揭較為貼切的解釋是向購房者提供的購房抵押貸款,其貸款的目的是為了購買房屋(主要是住宅),並不是所有的以房屋為抵押的貸款都可以稱作按揭。
